Purpose:

The purpose of these terms and conditions is to define the rights and obligations of the parties in connection with the online rental and sale of services and goods offered by Playa Location to the consumer on the www.playalocation.fr website. They apply without restriction or reservation to all sales concluded by the company Playa Location.

REGULATIONS FOR ELECTRIC BOATS

LAGON 55 (solar-powered and license-free) : 10 people (7 adults and 3 children*) - 700kg max load - 6h autonomy

SCOOP + (no license required): 7 people (5 adults and 2 children) - 500kg max load - 8 h autonomy

  • Children under 10 years of age and weighing less than 40 kg are recognized as children.
  • Dogs are allowed on board. However, you are responsible for any damage or scratches.
  • We recommend that you bring towels to protect the cushions.
  • For any damage or deterioration you will be asked to show your civil liability insurance.
  • You will be asked to show proof of identity before starting your tour.
  • The circuit breaker must be removed from the throttle if you are going swimming. ( Example: A child could activate the engine by mistake while you are swimming and the boat would leave without you OR the swim ladder is right next to the engine and propeller. You risk serious injury if someone activates the motor.)
  • Children under 2 are not recommended for long-term rentals.

PEDALO REGULATIONS

PEDALO: 5 persons- 4 Adults maximum

  • 1 adult required on board or minimum age 16 with parental consent
  • Maximum authorized weight: 350 kg
  • Maximum weight allowed on the slide: 50 kg

  • Prohibition on towing other floating equipment

CAUTION AND SAFETY RULES

Given the specific nature of the proposed activities, each participant is aware that he/she may run certain risks due to the remoteness, isolation and specific nature of the environment (the lake). They assume these risks with full knowledge of the facts, and must observe the rules of caution.

Instructions are given before each departure.

In the event of specific weather conditions, Playa Location may determine a compulsory route or direction. If you fail to comply with these instructions, you will be held directly responsible.

As our services take place in the natural environment (lake, beach), we expect all participants to behave in an exemplary manner and to comply strictly with safety and environmental rules.

Playa Location provides one lifejacket per participant on board and cannot be held responsible for the individual carelessness of one or more participants.

EQUIPMENT REQUIRED

To keep a good and unforgettable souvenir of your ride, remember to bring :

  • Dress for the weather
  • Sun protection (cap, T-shirt, sunglasses, sunscreen)
  • A bottle of water
  • Avoid wearing jewelry or valuables.

Playa Location cannot be held responsible for :

  • Loss or theft, including of vehicles and "personal effects" left in the Reception area.
  • breakage of objects (e.g. glasses, cameras, telephones, etc.) that participants may take with them during the activity.

The canister supplied is a watertight container, but is by no means an absolute guarantee of protection: misuse or the presence of a water bottle inside could damage personal belongings.

Playa Location declines all responsibility for any damage to objects placed in the canister.

GTC

Prices and taxes:

Prices are in euros and include all taxes. They are subject to change. In the event of a dispute, the price paid at the time of order will prevail.

Prices are available on the website and at reception.

Prices include: the chosen service and the loan of technical and safety equipment required for the activity (buoyancy vests, paddles).

Ordering / Booking:

Order confirmation:

The customer declares that he/she has read and accepted these General Terms and Conditions of Sale before booking.

Validation by the customer therefore implies acceptance of these General Terms and Conditions of Sale.

After checking the contents of the reservation, the customer will confirm it definitively at the payment stage. This confirmation constitutes the conclusion of the contract, and is therefore considered a "digital signature".

Once the contract has been concluded, Playa Location will send the Customer, by e-mail, a summary of the information entered on the reservation form. The invoice for the reservation will also be attached to the e-mail sent to the Customer.

Nevertheless, Playa Location reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order or who presents any form of risk in its eyes.

Proof of transaction:

The computerized registers, kept in the computer systems of the company Playa Location under reasonable conditions of security, are considered as proof of communications, orders and payments between the parties.

Purchase orders and invoices are archived on a reliable and durable medium that can be produced as proof.

Reservation

On the website: reservations must be made at least 24 hours in advance.

On site:bookings can be made on site or by telephone the same morning or up to 24 hours (twenty-four) in advance.

The reservation will be taken into account once the deposit of 30% of the total amount has been paid.

Any reservation also implies acceptance of all our terms and conditions.

Any reservation implies acceptance of the conditions of access to the activities (age, weight, number of participants,). No refund can be claimed if access to the activity is refused by our teams because the customer does not respect the conditions of access specified for the chosen activity.

La Playa Location cannot be held responsible for any personal injury or material damage caused by misuse or fraudulent use of the equipment. If, unbeknownst to the team members, more people than expected board the boat, La Playa Location cannot be held responsible, and the equipment may be withdrawn without compensation for the offenders.

Payment and security:

It is reminded that the fact of validating the order implies the Customer's obligation to pay the price indicated.

Customers can pay for their purchases in different ways.

At the time of payment, the bank requests personal information from the Internet user in order to verify the cardholder's identity and validate the transaction. The customer must provide his/her credit card number, depending on the type of card, its expiry date and the cryptogram number (3-digit number on the back of the credit card). The customer guarantees Titamàlà, when validating the order form, that he/she is in good standing with the issuer of the payment card.

Bring cash in case of computer problems, as there are no ATMs or banks in the village.

Reservation changes

Changes to the choice of activities are subject to the availability of the required equipment.

Playa Location reserves the right to reschedule departures according to the arrival times of previous vehicles.

Delay

In case of reservation, it is necessary to arrive 15 minutes before departure. Any delay of more than 15 minutes will result in the cancellation or postponement (schedule permitting) of the activity.

A late arrival will not postpone your scheduled return, so your booking will be shortened as the equipment must be returned on time to respect the smooth running of our schedule and for everyone's comfort.

Any delay of more than 5 minutes will be billed.

Cancellations and exclusions - Refunds:

Cancellations

At the customer's request

Cancellations must be made at least 48 hours before departure time. Otherwise, no refund of your deposit will be made by Playa Location.

If the service is interrupted, the customer or participant will not be entitled to any reimbursement.

At the time of booking, the choice of dates, times, number and type of boats according to the number and age of participants is the responsibility of the subscriber.

In all situations where the number of boats reserved does not correspond to the number of participants (lower and/or higher than the regulatory capacities of the boats), Playa Location will in no case be obliged to find a solution guaranteeing the departure of all participants.

Weather conditions

Playa Location reserves the right to cancel or adapt the outing according to weather conditions or the level of participants.

The activity may be cancelled for weather, safety or other reasons beyond our control.

In this case, the customer will be informed as soon as possible by e-mail or telephone.

La Playa Location cannot be held responsible in the event of bad weather on the day. If the activity is cancelled for reasons beyond our control, participants will not be entitled to any compensation.

If the outing cannot be carried out, the service may be rescheduled according to the following availability. 

La playa Location reserves the right (and is the sole decision-maker) to decide whether or not activities are feasible.

Playa Location's decision: Exclusions

La Playa Location reserves the right to refuse access to activities if participants do not respect the conditions of access or behave in a way that jeopardizes the safety or respect of team members, other users or the participants themselves. In such cases, NO refund can be claimed from customers.

Force majeure:

Neither party will have failed in its contractual obligations to the extent that their performance is delayed, hindered or prevented by a fortuitous event of force majeure. Force majeure shall be deemed to be any irresistible event or circumstance, external to the parties, unforeseeable, unavoidable, beyond the control of the parties and which cannot be prevented by the latter, despite all reasonably possible efforts.

The party affected by such circumstances will notify the other within ten business days of becoming aware of them.

The two parties will then meet, within a period of three months, unless this is impossible due to force majeure, to examine the impact of the event and agree on the conditions under which performance of the contract will continue.

If the case of force majeure lasts longer than one month, the present terms and conditions may be terminated by the injured party.

The following are expressly considered to be cases of force majeure or fortuitous events, in addition to those usually accepted by the jurisprudence of French courts and tribunals: blockage of means of transport, earthquakes, fires, storms, floods, lightning, stoppage of telecommunication networks or difficulties specific to telecommunication networks external to customers.

Insurance

  • Playa Location is insured for professional civil liability for the rental of nautical equipment (such as electric boats, pedalos, canoes, kayaks and paddles), and cannot be held responsible for activities booked with other service providers. It has an insurance policy with Générali.
  • However, Playa Location's liability does not replace the individual civil liability of each participant.

Damage to equipment and premises

The participant/tenant/customer is responsible for the equipment loaned to him/her for the activity, as well as for respecting the premises made available (pontoon, terrace, premises, etc.).

Any breakage or damage will be billed to the participant/tenant/customer, as will any related legal fees/proceedings. The participant/tenant/customer is responsible for the use of the equipment and for any damage to the rented equipment. He/she is responsible for all costs incurred as a result of such damage.

In the event of theft, loss or damage to the equipment loaned or to the premises, the participant/tenant/customer may be asked for "a full refund for the equipment", and undertakes to pay the cost of repairs within 10 days of receipt of the invoice.

However, the participant/tenant/customer may not be held liable for the harmful consequences of latent defects in the equipment that render it unfit for its intended use, provided that he/she can provide proof of said defects. 

AS A REMINDER:

All broken or damaged equipment will be reimbursed at the price of new.

La Playa Location declines all responsibility for the loss or breakage of telephones or any other valuable personal items during the activity.

Image rights

Unless you inform us in writing that you do not want us to do so, we may take photos for non-commercial purposes during your event.
We will respect the legal framework. Please note that only "recognizable" people can invoke their right to image and privacy.

Applicable law - Disputes:

These terms and conditions are governed by French law. This applies to both substantive and formal rules.

In the event of a dispute or claim, the consumer should first contact Playa Location for an amicable solution:

The customer undertakes to pay for any damage, breakage or costs incurred as a result of proceedings taken against him/her, even retroactively.
Penalties may be applied for any costs incurred as a result of collection proceedings.

Any dispute or claim must be sent to Playa Location by registered letter with acknowledgement of receipt within eight days of the end of the event. After this deadline, no dispute or claim will be considered valid.

In the event of litigation, and in the absence of amicable agreement, only the courts within the jurisdiction of the registered office of the company Playa Location will be competent (The competent courts are the courts of Draguignan - France).

Personal data protection:

In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, the processing of personal data collected on this site has been declared to the French Data Protection Authority (Commission Nationale de l'Informatique et des Libertés - CNIL).

The user has the right to access, modify, rectify and delete data concerning him/her. To exercise this right, the user should send an e-mail to Playa Location's customer service department. In any event, the user must state his/her surname, first name, address and, if applicable, user number, and attach a copy of an identity document. This right can also be exercised online.

Playa Location may communicate nominative information to its commercial partners. The User may thus receive commercial offers from third parties. However, we will not pass on such information unless necessary for the proper operation of the www.playalocation.fr website.

Finally, the consumer's e-mail address may be communicated to the aforementioned partners, unless the consumer requests otherwise. Of course, the consumer retains the option of refusing such communication either by post or e-mail.
